Article 1: Object of the Agreement

1. The lessor rents to the renter: A passenger car, hereinafter referred to as the "Rental Car."
2. The renter accepts the condition of the Rental Car at the moment of signing the rental agreement.

Article 2: Purpose

1. The Rental Car is exclusively intended for use as a passenger vehicle by holders of a valid driver's license.

Article 3: Duration and Termination Conditions

1. The rental is granted for the period specified in the contract.
2. The renter is not allowed to terminate the rental agreement free of charge. In case of a 2-week notice period, charges will apply.

Article 4: Rental Price - Insurance

1. The parties agree on a net basic rental price as specified in the contract.
2. The full amount for the rental car must be paid on the day of receipt.
3. The Rental Car is fully insured with all-risk coverage, subject to a deductible of 1000 guilders per accident, provided the renter complies with the rules.

Article 5: Costs - Charges - Damage

1. All costs resulting from mechanical failures are for the account of the lessor, unless caused by negligence or improper use by the driver.
2. Other costs such as tire damage and/or loss of car keys or parts will be charged to the renter. The new value will be calculated.
3. The renter remains fully liable in case of gross negligence, driving under the influence of alcohol or drugs, or other factors that affect driving ability.
4. The renter must immediately report any form of damage to the lessor. If damage is not reported immediately, all costs related to the damage will be charged to the renter, even if all-risk insurance or a deductible buyout was agreed.
5. In case of damage caused by third parties up to an amount of 150,000 guilders, the damage will be covered by our insurance company. In such cases, no compensation will be made by us, and the handling will be fully managed by our insurance company according to their terms.
6. As a car rental company and individuals, we are not liable in case of an accident resulting in injury or death.

Article 6: Maintenance and Repairs

1. The lessor will make every effort to maintain the rental car in good condition and will have any repair and wear-and-tear work carried out as quickly as possible.
2. The renter must use the rental car responsibly and as described in Article 2.

Article 7: Return of the Rental Car

1. The renter is obligated to return the rental car upon termination of this rental agreement for any reason.
2. The rental car must be returned in the condition it was in at the start of this rental agreement.
3. The rental car is always delivered to the renter with a full tank of gas. It must also be returned in the same condition. If not, the renter will be charged later.

Article 8: Explicit Termination Clause

1. The rental agreement between the parties will automatically be dissolved in case of the loss or destruction of the rental car. In such a case, the renter has no right to a refund of the rental amount.
2. The rental agreement will be terminated by law if either party fails to meet their obligations arising from the rental agreement.

Article 9: Subletting and Transfer of Rental

1. The renter may not transfer the contract to third parties.
2. The rental car may not be fully or partially sublet without the lessor's consent.

Article 10: General Rules

1. Smoking is not allowed in the rental car.
2. It is prohibited to drive under the influence of alcohol or drugs in the rental car.
3. Animals are not allowed to be transported in the rental car.
4. The renter is responsible for replacing the tire in case of a flat tire.
5. The renter is not allowed to drive if a warning light is on. If the renter continues driving under these conditions, all costs will be charged to the renter.
6. The renter is not allowed to drive if the temperature gauge rises above the halfway point. If this happens, all costs will be charged to the renter.
7. Any new dents or scratches on the rental car are the responsibility of the renter.
8. The renter must park the car behind a closed gate after 10:00 PM. If this is not done and damage or theft occurs, all damage or costs are for the renter's account. This also applies if the renter has purchased all-risk insurance or a deductible buyout.

Article 11: Applicable Law

Any dispute regarding the validity, interpretation, execution, or termination of the rental agreement will be exclusively resolved in the competent court in Willemstad, Curaçao.

Article 12: General Terms

By signing this agreement, the renter declares that they have read and agree to the general terms and conditions.
